Terms of Use

Internet Service is being provided by Silicon Travel, LLC (hereinafter referred to as, "Silicon Travel") in the leased rental property (hereinafter referred to as, "Provided Service"). This Terms of Use Policy Agreement is between Silicon Travel and the named renter of the leased rental property. By accepting this Terms of Use Policy Agreement, you represent and warrant that you are the named renter of the leased renter property and you agree that any and all use of the Provided Service, including any and all access to websites, webpages and other resources listed on, posted on or otherwise made available over the Internet, is subject to the conditions set forth below.

Use of the Provided Service indicates your acceptance of all of the terms and conditions set forth in this Terms of Use Policy Agreement, and you agree you are bound by all of the conditions set forth herein. The terms and conditions of this Terms of Use Policy Agreement apply to each person using the Provided Service, including but not limited to guests of the leased rental property . You agree and understand that use of the term "you” and "your” in this Terms of Use Policy Agreement applies not only to you, the named renter of the leased rental property, but also includes each and every user of the Provided Service. Therefore, you, as the named renter of the leased rental property, agree that you are and shall be responsible for any and all use of the Provided Service by any and all persons.

IF YOU DO NOT AGREE WITH THESE CONDITIONS, DO NOT USE THIS SERVICE!

1. You agree that your use of the Provided Service shall always comply with applicable laws, regulations, rules and orders. In using the Provided Service, you agree, without limitation, not to:
   • undertake or accomplish any unlawful purpose, or take any action which in any way constitutes, promotes or encourages conduct that would constitute a criminal offense is illegal, or otherwise violates any local, state, federal or non-U.S. law, order or regulation;
   • host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, download, access, copy, reproduce, store create derivative works of or use any information, data, software, content or other material which a reasonable person could deem to be unlawful;
   • host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, download, access, copy, reproduce, store, create derivative works of or use information, data, software, content or other material that is protected by trademark, patent, copyright, trade secret, copyright or other proprietary right, without obtaining permission of the owner of such right;
   • host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, copy, reproduce, or create derivative works of unsolicited bulk or commercial messages commonly known as "spam”;
   • host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, download, access, copy, reproduce, store, create derivative works of or use any information, data, software, content or other material that is harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy or publicity rights, that is hateful, or racially, ethnically or otherwise objectionable, that harasses or advocates harassment of another person, or that is false, misleading or deceptive;
   • impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
   • host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, download, access, copy, reproduce, store, create derivative works of or use any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, network, hardware or telecommunications equipment;
   • harm or attempt to harm a minor, including, but not limited to, by hosting, possessing, disseminating or transmitting material that is unlawful, including child pornography or obscene material;
   • breach or attempt to breach the security of another user or attempt to gain access to any organization’s or person’s network, account, hardware, computer(s), software(s) or data without the knowledge and consent of such organization or person, attempt to circumvent the user authentication or security of any host, network or account, or to host, post, publish, display, send, e-mail, transmit, distribute, disseminate, make available, upload, download, access, copy, reproduce, store or create derivative works of tools designed for compromising security;
   • use the Provided Service for any commercial, non-personal use; or
   • do any other act which is otherwise considered an inappropriate use of the Provided Service, as determined in Silicon Travel’s sole judgment.
2. By accessing the Internet through the provided computer, your own personal computer, or other computing device including but not limited to smart phones, tablets and other Internet-capable devices, you can access websites, webpages or Internet resources of third-parties unaffiliated with Silicon Travel or the property management company providing rental services to the home (hereinafter referred to as, "Rental Company”). Provision of Internet access through the use of a Provided Service in no way implies that Silicon Travel or Rental Company is affiliated or associated with, or otherwise recommends, certifies or endorses any website, webpage or Internet resource listed on, posted on or otherwise made available over the Internet. Silicon Travel and Rental Company do not represent or endorse the accuracy or reliability of any website, webpage or Internet resource accessed through the Provided Service. You acknowledge and agree that any reliance upon any information accessed through the Provided Service shall be at your sole risk.
3. Websites, webpages and/or Internet resources accessed by you may contain facts, views, opinions, statements, and materials of third-party individuals and organizations. You acknowledge and agree that Silicon Travel and Rental Company have no liability to you to the extent you access Websites, webpages and/or Internet resources using the Provided Service which contain pornographic material, inappropriate language, or any other material, including, but not limited to, language, photographs, video, or any other media, that is inappropriate or not intended for use or viewing by children under the age of eighteen years old.
4. You acknowledge and agree that Silicon Travel and Rental Company are in no way responsible for the content or performance of any portion of the Internet, including any website, webpage and/or Internet resource which may be accessed through the Provided Service. You hereby waive any liability on the part of Silicon Travel or Rental Company should you access any website which may contain material inappropriate for children under the age of eighteen, as described in paragraph 3 above.
5. Silicon Travel and Rental Company do not warrant or make any representations regarding the operation of the Provided Service or the use, validity, accuracy, or appropriateness of any materials accessed on the Internet through the use of the Provided Service. Your use of the Provided Service is at your sole risk. The Provided Service is provided on an "as is” and "as available” basis. Silicon Travel and Rental Company expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of fitness for a particular purpose, merchantability, non-infringement, quality, performance, non-interference with information and accuracy of content. There is no warranty that information provided hereunder, our efforts or the provided services will fulfill any of your particular purposes or needs. Silicon Travel and Rental Property assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, user communications. Silicon Travel and Rental Property are not responsible for any incorrect or inaccurate content posted on the website maintained by Silicon Travel used in accessing the Provided Services, whether caused by users of the website or by any of the equipment or programming associated with or utilized in the website.
6. In no event shall Silicon Travel or Rental Company, its affiliates, subsidiaries, agents, or assigns, be liable for any direct, indirect, special or consequential damages or any other damages whatsoever resulting from, arising out of or in connection with the use, misuse or inability to use the Provided Service whether in an action for contract, negligence or other tortuous action, even if Silicon Travel or Rental Company has been advised of the possibility of such damages. The foregoing limitation of liability excludes, without limitation, any liability and damages resulting from, arising out of or in connection with: any use by you of any materials accessed on the Internet, any alleged liability or damage caused by access by you to any materials deemed inappropriate for children under the age of eighteen as described in paragraph 3 above, your access to the Internet through the use of the Provided Service, your access to any other information available through your access of the Internet on the Provided Service, and any breach by you of this Terms of Use Policy Agreement.
7. You agree that any such use of the Provided Service and monitoring all use of the Provided Service including use of the Provided Service by any children under the age of eighteen is your sole responsibility. You hereby forever release Silicon Travel and Rental Company from any responsibility or liability resulting from, arising out of or in connection with any and all use of the Provided Service and the provided computer including any unintended, unauthorized, illegal or inappropriate use of the Provided Service and/or provided computer by any person, including any child under the age of eighteen. For the avoidance of doubt, you hereby release Silicon Travel and Rental Company from any responsibility or liability for any viewing by a child under the age of eighteen of any inappropriate materials found on the Internet, as described in paragraph 3 above.
8. Notwithstanding anything herein to the contrary, this Terms of Use Policy Agreement does not constitute a conveyance or assignment of any right, title or interest in and to any hardware, software, or other intellectual property assets including those protected under copyright, trademark, or patent. You acknowledge and agree that all hardware, software and works of authorship used in the provision of or that is otherwise part of the Provided Service in addition to the provided computer, including its hardware, software and display, is owned by Silicon Travel and its licensors.
9. Any violation by you of these Terms of Use Policy Agreement shall immediately result in a suspension of the Provided Services to you and may further subject you to legal action by Silicon Travel, Rental Company and/or any harmed third party.

You are required to acknowledge that you have read and agree to these conditions prior to your use of the Provided Service in any capacity.

When we collect information from you, we want you to know how it is used. This privacy statement defines privacy aspects specific to silicontravel.com, adconsole.silicontravel.com, console.silicontravel.com, and vacationattendant.com. Our products & services are designed to appeal to children under the age of 13 for use during vacation. Therefore, we expect parental guidance before allowing any child under the age of 18 to complete any on-line request form. While our services include content filtering, it is not possible to block all objectionable material, so parental guidance is advised.

Providing us with your date of birth is completely optional, so it is possible for someone of any age to register and use our products or services. In the case we discover that a child under 13 has provided us with consent for marketing, we will immediately remove this consent. Information Practices

To maximize the value of our services, we may request information from you when you visit our websites or purchase our products. When we collect information from you, we’ll tell you what is being collected, how it is collected, by whom it is being collected, why it is being collected and to whom it may be disclosed. We identify the information that is necessary to fulfill your request. Whenever we ask for additional or optional information, we identify those fields appropriately so that you know what is required to provide the requested service.

Whenever you purchase a product or service, we may request certain personally identifiable information, including your name, address, phone number, e-mail address and company name. Internet Technologies

Our websites may use some or all of the following common technologies:

• Cookies & Beacons. A “cookie” is a small piece of information that our Web site may provide to your browser while you are at our site. Silicon Travel’s products & services supply your browser with cookies that contain a unique identifier used to better understand Web site usage in the aggregate so that we know what areas of our site users prefer (e.g., based on the number of visits to those areas). Except in secure log-in areas these cookies are not linked to any personally identifiable information that you provide. You do not have to accept cookies from our site unless you are accessing a secure log-in function which may require cookies. Most browsers have a default to accept and maintain cookies.Web beacons (website navigational information) contain standard information from your web browser, such as browser type, language, IP address, and actions that you take to navigate or website, such as pages viewed and links clicked. This information is used to help us tailor our websites as well as detecth and prevent security threats or abuse.
  
  When in a secure area, you may receive a cookie as part of the authentication process. This cookie will be used to confirm your identity each time you wish to access a different page within the secure log-in area. The cookie enables you to go from screen to screen without being repeatedly asked to authenticate your identity.
  
  Third party tracking systems may be used on our websites. These tracking systems may assign different cookies to your browser. These cookies may be used to track how and when you utilize certain links on our site. This information is used to help us better understand and improve our site. You may choose not to accept these cookies and will still have full access to site functionality. These cookies do not follow you once you leave our site, nor are they linked to personal information you provide elsewhere on our site.
• Website Usage Data. With or without cookies, our website keeps track of usage data, such as the source address that a page request is coming from, your IP address or domain name, the date and time of the page request, the referring Web site (if any) and other parameters in the URL. We use this data to better understand website usage in the aggregate so that we know what areas of our website visitors prefer. This information is stored in log files and is used for aggregated and statistical reporting. This log information is not linked to personally identifiable information gathered elsewhere on the site.
• Links to the Internet. In providing direct links to other websites, you will pass through a Silicon Travel server before being "re-directed" onto the Internet. This allows Silicon Travel to send you to the proper website even if the destination website has changed locations. We store which message you clicked on and its location within the software prior to linking you to the Internet. Silicon Travel servers register the website you request from within the console. Silicon Travel does not register your surfing behavior after that point, however, content filtering software may prevent access to a website deemed objectionable. We use any gathered information, in the aggregate, to determine usage levels for our various on-line services.

General information practices:

• Mandatory and Optional Information. We identify the information that is necessary to fulfill your request. Whenever we ask for additional or optional information, we identify those fields appropriately so that you know what is required to provide the requested service. If you choose not to provide mandatory information, we will not be able to provide you with the service you are requesting.
• Third-Party Sites. Some of the products and services we offer are provided by Silicon Travel's business partners. To fulfill your request for such services, we will forward your customer information to our partner, as necessary. Links to third-party websites, such as those of our business partners and online advertisers may collect information about you. Silicon Travel is not responsible for the actions of these third parties. We encourage you to review their privacy policies to learn more about what, why and how they collect and use personally identifiable information.
• E-mail Message Formatting. When sending you e-mail we may use an image called a single-pixel GIF, that allows us to (1) format messages that best align with your computer’s capabilities, and (2) determine whether you've opened an HTML e-mail. When you click on a link within an e-mail message, you will first pass through our server, then you are redirected on to the Internet. We use this click-through data on an aggregate level to evaluate response rates to our e-mail messages and to determine which links are most useful to our customer base.
• Service Providers. In some cases, we will employ or work with service providers such as consultants, temporary workers, third party software developers, or outsourcers to complete a business process or provide a service on our behalf. For example, we may use service providers to deliver products, offer online software applications, or send e-mails. When we employ service providers, we may need to share your personally identifiable information. Service providers are strictly prohibited from using your personally identifiable information for purposes other than to act on our behalf.
• Service Alerts and Critical Notices. Your personally identifiable information may be transferred in connection with a sale, merger, transfer, exchange or other disposition (whether of assets, stock or otherwise) of all or a portion of a business of Silicon Travel and/or its subsidiaries. You will have the opportunity to opt out of further secondary use of your information following any change of control.
• Changes to Our Privacy Policy. If we plan to make significant changes to any of our privacy policies or practices with respect to how we use personally identifiable information, we will post those changes to the SiliconTravel.com website 30 days before they take effect.
• Legal Disclosures. In some cases we may disclose certain information to comply with a legal process, such as a court order, subpoena, search warrant, or law enforcement request.

Use of personally identifiable information that you provide to us.

We give you the opportunity to control the use of your personal information for purposes other than to fulfill your request. We will provide you the opportunity to opt-out of secondary uses of personally identifiable information you provide us, whenever we gather it. Simply notify us during the information collection process.

We work to protect personally identifiable information from loss, misuse, or unauthorized alteration.

We employ industry recognized security safeguards to help protect the personally identifiable information that you have provided to us from loss, misuse, or unauthorized alteration. Whenever we prompt you to transmit sensitive information, such as a credit card number, to us through our products or services, we support encryption of your data as it is transmitted to us.

We work to protect personally identifiable information stored on the site's servers from unauthorized access using industry standard computer security products, such as firewalls, as well as carefully developed security procedures and practices. All employees must review and sign a written confidentiality statement, which include limiting access to sensitive information to only those employees who require such information and enforcing strict password protocols for all employees. We use both internal and external resources to review the adequacy of our security measures on a regular basis.

While your data is important to us, there is no full-proof method for preventing intruders from gaining access and therefore we assume no liability for its protection.

• Email. If you wish to withdraw consent for use of your marketing data, you can unsubscribe from an email, or contact us at support@silicontravel.com to have your data removed.
• Customer Service call (800) 459-2256 or Online Chat. We may offer you the opportunity to chat online with our sales and service advisors, as well as Property Management business partners. When ordering or requesting products or services through our online chat service, we ask for your name, address, phone number, and e-mail address to process your order. We do not share your contact information with outside companies for their promotional use. On occasion, we may, however, contact you with special offers that may interest you. If you do not wish to receive such communications, simply indicate your contact preferences at the time you place the order.
• Contests and Surveys. From time to time, we may offer you the option to participate in contests or surveys. If you would like to participate, we may ask you for contact information, preferences, or other information. This information may be used to conduct research, improve our offerings, or award prizes. We may also ask for more specific demographic information such as age or gender to better understand who uses our site and to make the site more useful for you. Our contests may have separate rules and we will identify how the information that you supply will be used in each case.
